SOMATIKA OUTDOOR FLOATING SOUND BATH
ATTENDEE WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK
This Waiver, Release of Liability and Assumption of Risk Agreement ("Agreement") is entered into between Somatika ("Organizer") and the undersigned participant ("Attendee").
By signing this Agreement and participating in an Outdoor Floating Sound Bath, the Attendee acknowledges that they have read, understood, and agree to the following terms.
1. ACKNOWLEDGEMENT OF ACTIVITY & ASSUMPTION OF RISK
The Attendee acknowledges and understands that participation involves a floating wellness experience conducted in and around a swimming pool or other body of water while resting on inflatable floating equipment.

The Attendee further acknowledges that participation involves inherent risks, including but not limited to:

Slipping, tripping, falling, or loss of balance.

Contact with water, including the possibility of becoming wet or entering the water.

Drowning or other water-related injuries.

Injury arising from entering or exiting the pool.

Exposure to sun, heat, wind, smoke, insects, or changing weather conditions.

Emotional or psychological responses associated with meditation or sound healing.

Muscles soreness, dizziness, nausea, fainting, aggravation of pre-existing medical conditions, allergic reactions, or other unforeseen physical responses.

Risks associated with the acts or omissions of other participants.

The Attendee voluntarily assumes all risks associated with participation, whether known or unknown, foreseeable or unforeseeable.

The Attendee confirms that they are physically and mentally capable of participating and accept full responsibility for determining whether participation is appropriate for their individual circumstances.
The Attendee confirms that they will not participate if they believe participation would present an unreasonable risk to themselves or others.
The Attendee understands that participation is voluntary and that they may discontinue participation at any time.
The Outdoor Floating Sound Bath is offered solely as a wellness experience and is not intended to diagnose, treat, cure, or prevent any medical or psychological condition. It is not a substitute for medical advice or treatment.
To the fullest extent permitted by applicable law, the Attendee releases, waives, and forever discharges Somatika and its owners, directors, employees, contractors, volunteers, facilitators, representatives, successors, and assigns from any and all claims, demands, actions, damages, losses, costs, or expenses arising directly or indirectly from participation in the Outdoor Floating Sound Bath, including claims arising from personal injury, illness, emotional distress, property damage, disability, or death, except where liability cannot be excluded by law.
4. PERSONAL RESPONSIBILITY
The Attendee agrees to:

a) Follow all instructions provided by Somatika.

b) Exercise reasonable care while entering, exiting, and participating in the experience.

c) Respect all equipment provided.
​
d) Immediately notify Somatika if they experience discomfort, dizziness, illness, or wish to discontinue participation.
​
e) Refrain from participating while impaired by alcohol, cannabis, illegal drugs, or any substance that may impair judgment or physical ability.
The Attendee accepts full responsibility for all personal belongings brought to the event.
​
Somatika shall not be responsible for lost, stolen, or damaged personal property, including but not limited to mobile phones, watches, jewelry, clothing, footwear, eyewear, wallets, or other valuables.
The Attendee acknowledges that clothing and personal belongings may become wet during participation.
The Attendee agrees to exercise reasonable care while using the venue and Somatika's equipment.
The Attendee may be held responsible for damage caused through intentional misconduct or negligent use of equipment or property, excluding ordinary wear and tear.
7. PHOTO & MEDIA CONSENT (OPTIONAL)
From time to time, photographs or video may be taken during Somatika events for promotional purposes.​
The Attendee agrees to indemnify and hold harmless Somatika from any claims, losses, liabilities, damages, costs, or legal expenses arising from the Attendee's negligence, misconduct, breach of this Agreement, or actions brought by third parties arising from the Attendee's participation.
If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
This Agreement shall be governed and interpreted in accordance with the laws of the Province of Alberta.
The Attendee acknowledges that:

They have carefully read this Agreement in its entirety.

They understand the nature of the activities and the risks involved.

They understand that they are giving up certain legal rights, including the right to commence legal proceedings against Somatika to the extent permitted by law.

They sign this Agreement voluntarily and without inducement.
