FLOATING FREQUENCIES ~ FLOATING SOUND BATH
ATTENDEE AGREEMENT, WAIVER & RELEASE
Somatika & The Westin Calgary
This Agreement is entered into between Somatika (“Organizer”), The Westin Calgary (“Hotel”), and the individual attendee named below (“Attendee”).
By registering for and attending Floating Frequencies, a floating sound bath experience at The Westin Calgary, the Attendee agrees to all terms outlined in this Agreement.
1. ACKNOWLEDGEMENT OF ACTIVITY & ASSUMPTION OF RISK
The Attendee understands and acknowledges that:
a) Floating Frequencies – Floating Sound Bath involves lying or sitting on inflatable mattresses or seating in or near a swimming pool environment, with exposure to water, sound vibration, dim lighting, and relaxation practices.
b) Participation involves inherent risks including, but not limited to: slipping, falling, loss of balance, contact with water, getting wet, dizziness, emotional release, allergic reactions, muscle strain, aggravation of pre-existing conditions, or other physical or psychological responses.
c) The Attendee voluntarily assumes all risks associated with participation, including risks of injury, illness, or death, whether caused by negligence, environmental conditions, equipment, or otherwise.
d) The Attendee is responsible for determining their own suitability to participate and confirms they are in adequate physical and mental condition to do so.
To the fullest extent permitted by Alberta law, the Attendee releases, waives, and discharges Somatika, The Westin Calgary, their owners, employees, contractors, facilitators, agents, and representatives from any and all claims, demands, actions, or liabilities arising from:

Personal injury, illness, or death

Emotional or psychological experiences
-
Water exposure, slipping, or falling
-
Use of inflatable mattresses, blankets, or equipment
-
Any condition of the Hotel premises
-
Participation before, during, or after the session
This release includes claims arising from the negligence, gross negligence, or breach of statutory duty of Somatika or The Westin Calgary, except where prohibited by Alberta law.
3. PERSONAL RESPONSIBILITY
The Attendee agrees to:

Follow all instructions from Somatika facilitators and Hotel staff

Enter and exit the pool area carefully

Refrain from participation if under the influence of alcohol

Disclose to themselves any medical conditions that may make participation unsafe
The Attendee understands the session is not medical treatment and does not replace professional medical advice.
Attendee agrees to pay for any damage incurred to the Hotel spaces, furnishings, pool equipment, or property caused by the Attendee while attending Floating Frequencies – Floating Sound Bath at The Westin Calgary.
Attendee will not be responsible for ordinary wear and tear or for any pre-existing damage.
5. FOOD & BEVERAGE
(HOTEL REQUIREMENT)
Due to licensing and quality control:
a) All food and beverage must be provided, prepared, and served by The Westin Calgary and consumed on Hotel premises.

b) Menu pricing will be confirmed by the Hotel.

c) Additional charges:

20% service charge on all food and beverage revenue

Applicable taxes added to final invoice
This Agreement is subject to all applicable federal, provincial, and municipal laws. Somatika, The Westin Calgary, and the Attendee agree to cooperate to ensure compliance.
7. WATER EXPOSURE & PROPERTY
a) The Attendee acknowledges that getting wet is a possibility and accepts responsibility for clothing and personal items.
b) Somatika and The Westin are not responsible for loss or damage to personal belongings including phones, jewelry, glasses, or clothing.
c) Pillows and blankets are provided as a courtesy and used at the Attendee’s own risk.
The Attendee agrees to indemnify and hold harmless Somatika and The Westin Calgary from any claims, costs, legal fees, or damages arising from:

The Attendee’s actions or negligence

Breach of this Agreement
-
Damage caused by the Attendee
-
Claims brought by third parties related to the Attendee
9. PHOTO & MEDIA (optional)
The Attendee understands that non-identifying photos or videos may be captured in the space. Attendee may opt out by notifying Somatika in writing prior to the session.
If any portion of this Agreement is deemed unenforceable, the remaining provisions remain in full force.
This Agreement is governed by the laws of the Province of Alberta.
12. INDIVIDUAL CONSENT & GROUP BOOKINGS
a) Each participant must sign this Agreement individually. A purchaser cannot waive rights for another adult.
b) No person will be permitted to participate without a signed waiver.
c) Somatika and The Westin may refuse entry without refund if unsigned.
d) Group organizers indemnify Somatika and The Westin Calgary for allowing any unsigned participant.
