KANANASKIS WELLNESS WEEKEND
PARTICIPANT AGREEMENT, WAIVER & RELEASE
Somatika - Tim Horton's Children's Ranch
This Agreement is entered into between Somatika (“Organizer”), Tim Horton Children’s Ranch (“Venue”), and the individual participant named below (“Participant”).
By registering for and attending the Kananaskis Wellness Weekend, the Participant agrees to all terms outlined in this document in addition to any waiver required by the Venue.
The weekend may include sound baths, breathwork, movement and yoga practices, forest bathing, cold water river immersion, sauna use, hiking, drum circle, workshops, shared meals, creative activities, and sessions offered by independent guest practitioners including acupuncture.
All activities are voluntary and participants may decline or modify any experience at any time.
2. ASSUMPTION OF RISK - GENERAL
The Participant acknowledges inherent risks including but not limited to:

slips, trips, and falls on trails, stairs, docks, riverbanks, and cabin areas
-
changing mountain weather and uneven terrain
-
emotional or physical responses during wellness practices
-
shared accommodation environments
-
aggravation of pre-existing medical conditions
The Participant freely assumes all such risks whether caused by negligence or otherwise, to the extent permitted by Alberta law.
3. COLD WATER RIVER IMMERSION
Participation in any cold dip or river immersion involves additional risks including:
-
cold shock response and rapid breathing
-
dizziness, fainting, or loss of coordination
-
slippery or unstable rocks and current
-
changes in blood pressure or heart rate
The Participant agrees to enter the water only when they feel capable, to follow facilitator guidance where provided, and to exit immediately if discomfort occurs.
Sauna services are provided by an independent operator and are subject to the operator’s own consent and waiver. Participation in sauna experiences is governed exclusively by that provider’s policies, and Somatika does not assume liability for sauna operations.
5. SHARED BUNKHOUSE ACCOMMODATION
The Participant acknowledges that lodging includes shared rooms, bunk beds, stairs, and communal facilities. The Participant agrees to:

use ladders and stairs with care
-
respect quiet hours and shared spaces
-
maintain appropriate personal boundaries and consent with other guests
6. INDEPENDENT PRACTITIONERS - ACUPUNCTURE & OTHER MODALITIES
Certain services such as acupuncture are provided solely by independent licensed practitioners. These practitioners are not providing services on behalf of Somatika. The Participant will complete any additional consent required by those providers and understands Somatika is not responsible for clinical outcomes of regulated health services.
To the fullest extent permitted by law, the Participant releases Somatika, its owners, employees, facilitators, contractors, volunteers, and the Venue from any claims arising from participation before, during, or after the event, including claims of negligence except where prohibited by Alberta law.
8. PERSONAL RESPONSIBILITY
The Participant agrees to:

follow facilitator and venue instructions
-
refrain from participation if under the influence of impairing substances
-
listen to their body and modify or decline activities
-
seek medical advice where appropriate
The weekend does not constitute medical treatment or diagnosis.
9. CODE OF CONDUCT & REMOVAL
Somatika may remove any participant without refund for unsafe behavior, intoxication, harassment, or failure to follow safety directions.
10. MEDICAL & DIETARY RESPONSIBILITY
Participants are responsible for disclosing relevant conditions and managing personal medications and dietary needs. An allergen-free environment cannot be guaranteed.
Somatika and the Venue are not responsible for loss or damage to personal belongings.
The Participant agrees to indemnify Somatika and the Venue from claims arising from the Participant’s actions or breach of this Agreement.
Photo and Video images may be captured throughout the weekend. Participants may opt out in writing.
14. SEVERABILITY & GOVERNING LAW
This Agreement is governed by the laws of Alberta. If any portion is unenforceable, the remainder remains valid.
